General Terms and Conditions
Golf Travel Pty Ltd trading as On The Tee and On The Tee Travel (“OTT”, “we”, “us” or “our”). These Terms apply to all trips, tours and travel arrangements booked or organised by OTT.
Trip-specific terms may also apply and will be set out in the applicable booking form, itinerary or brochure. If there is any inconsistency, the trip-specific terms will apply to the extent of that inconsistency.
By making a booking with OTT, you agree to these Terms.
1. OTT’S ROLE AS BOOKING AGENT
OTT acts as a booking agent for travel services provided by independent third-party suppliers, including accommodation providers, golf courses, airlines, transport operators, tour and activity providers, restaurants, venues and guides.
OTT does not itself provide these services. Services arranged by OTT are subject to the relevant supplier’s terms and conditions, including cancellation policies, conditions of carriage and limitations of liability.
OTT will use reasonable care in arranging and administering bookings but does not control independent suppliers and, to the fullest extent permitted by law, is not responsible for their acts or omissions.
Nothing in these Terms excludes, restricts or modifies any rights or liability that cannot lawfully be excluded, restricted or modified.
2. BOOKING AND ACCEPTANCE
Bookings may be made online, by telephone or by email. A booking is confirmed when OTT receives the required deposit and issues written confirmation. Once confirmed, the traveller is bound by these Terms and any applicable trip-specific terms. If you book on behalf of another traveller, you confirm that you have authority to accept these Terms on their behalf.
3. MINIMUM PARTICIPANT NUMBERS
Some tours are subject to minimum participant numbers. Travellers should not make flight arrangements until OTT confirms that the tour will proceed. If the minimum number is not reached, OTT may cancel the tour and refund amounts paid, or offer an amended itinerary, group arrangement or price.
4. PRICES AND PAYMENTS
The applicable deposit and payment schedule will be specified in the brochure or booking documentation.
The required deposit must be paid by the due date to secure a place. Failure to make a payment when due may result in cancellation and applicable cancellation charges. Prices are based on the itinerary and inclusions specified at booking and may be subject to supplier availability, exchange-rate movements, taxes, fees or other applicable charges.
5. CANCELLATIONS BY THE TRAVELLER
Cancellation requests must be made in writing.
OTT’s tours are group arrangements priced on the basis of confirmed participant numbers. A traveller’s cancellation may increase costs for the remaining travellers and may leave OTT liable for prepaid supplier commitments. Accordingly, payments made to OTT are non-refundable if a traveller cancels, except where a refund is expressly provided for in the applicable booking terms.
Unless different terms apply to a particular trip:
Before final payment: the deposit is non-refundable.
After final payment: 100% of the tour price is non-refundable.
Supplier charges: additional cancellation or non-refundable charges may apply where imposed by suppliers.
Travellers are strongly advised to obtain comprehensive travel insurance, including cancellation and curtailment cover.
6. CHANGES TO THE ITINERARY
OTT will use reasonable endeavours to operate tours substantially in accordance with the published itinerary. However, changes may be necessary due to supplier availability, operational requirements, weather, transport disruption, safety considerations or other circumstances beyond OTT’s reasonable control. Changes may include accommodation, golf courses or tee times, flights, transfers, restaurants, activities, tour hosts, timings or the order of itinerary items. Where a service becomes unavailable, OTT will use reasonable endeavours to arrange a suitable alternative of a comparable standard where practicable and will notify travellers of material changes as soon as reasonably practicable.
7. ERRORS AND OMISSIONS
OTT takes reasonable care to ensure that booking and travel information is accurate, but errors or omissions may occur, including in information supplied by third parties. OTT may correct genuine clerical, typographical or obvious errors. Where an error materially affects a confirmed booking, OTT will notify the traveller and work towards an appropriate resolution in accordance with applicable law.
8. TRAVEL INSURANCE
Comprehensive travel insurance is mandatory for all travellers. Travellers must maintain appropriate cover for the entire trip, including, where relevant, medical expenses, evacuation and repatriation, cancellation and curtailment, travel delays, personal liability, luggage and golf equipment.
Travellers are responsible for checking their policy’s exclusions, limits and conditions. OTT is not an insurer and does not guarantee that an insurance claim will be accepted.
Where available and appropriate, travellers should consider Cancel For Any Reason (CFAR) cover.
9. PASSPORTS, VISAS AND TRAVEL REQUIREMENTS
Travellers are responsible for obtaining valid passports, visas, permits and any other documentation required for their itinerary. Travellers must also check current entry, health, vaccination and other travel requirements before departure. Travel requirements can change at short notice. Travellers should obtain current information from the Australian Government’s Smartraveller service.
OTT does not guarantee that a traveller will meet the entry requirements of any destination.
10. HEALTH, FITNESS AND RISK
Travellers are responsible for determining whether they are fit to participate in the trip and should obtain medical advice where appropriate. Golf and travel activities involve inherent risks, including illness, injury, falls, weather and environmental conditions, transport incidents, equipment or facility hazards, crime, wildlife and limited access to medical facilities. Travellers must take reasonable precautions and follow reasonable safety instructions provided by OTT, suppliers, guides and other relevant personnel.
11. MEDICAL ASSISTANCE
In an emergency, OTT may take reasonable steps to obtain medical or emergency assistance for a traveller. Where a traveller cannot provide instructions, OTT may arrange reasonable emergency assistance or treatment. Travellers are responsible for their medical, hospital, evacuation and related expenses, subject to applicable law and their travel insurance.
12. GOLF COURSE CONDITIONS AND WEATHER
Golf courses may undergo maintenance, renovation or other works and conditions or availability may change at short notice.
Weather and other circumstances may affect golf, transport and itinerary arrangements. Where an activity is cancelled, materially affected or changed, OTT will use reasonable endeavours to arrange a suitable alternative where practicable. Any refund or credit is subject to amounts recoverable from suppliers and applicable contractual or legal rights.
13. DIETARY REQUIREMENTS
Travellers must advise OTT of any dietary requirements, food allergies or intolerances at booking or as soon as known. OTT will communicate notified requirements to relevant suppliers where reasonably practicable but cannot guarantee that every venue can accommodate particular dietary needs or allergies. Travellers with severe allergies or medically required dietary restrictions are responsible for taking appropriate precautions and should confirm requirements directly with the relevant supplier where necessary.
14. SECURITY BONDS AND ADDITIONAL CHARGES
Suppliers may require security bonds, deposits or credit card authorisations for incidentals, damage or other expenses. Travellers must provide these where reasonably required. Travellers are responsible for additional charges properly imposed by suppliers arising from their acts or omissions or otherwise chargeable under the supplier’s terms, including damage, loss, misuse, unpaid personal expenses or other attributable costs. Where OTT incurs an amount properly chargeable to a traveller, OTT may recover that amount from the traveller, including reasonable recovery costs.
15. EXCLUSIONS
Unless expressly stated as included, the tour price generally excludes flights, travel insurance, tips and gratuities, porterage, personal expenses, golf-club hire, meals and drinks, visas and travel documentation, excess baggage, and any other items not expressly included in the itinerary.
16. FORCE MAJEURE
A Force Majeure Event means an event beyond OTT’s reasonable control that could not reasonably have been prevented or avoided, including war, terrorism, natural disasters, pandemics, severe weather, transport disruption, government action, travel restrictions, changes in law or other events materially affecting a trip.
If a Force Majeure Event materially affects a trip, OTT may alter, postpone, reschedule, substitute or cancel affected arrangements. OTT will use reasonable endeavours to minimise disruption and notify travellers of material changes as soon as reasonably practicable.
Any refund or credit will be subject to amounts recoverable from suppliers. Amounts retained by suppliers or otherwise not reasonably recoverable may not be refundable.
17. LIMITATION OF LIABILITY
OTT acts as a booking agent and does not control independent third-party suppliers.
To the fullest extent permitted by law, OTT is not liable for loss, damage, injury, illness, delay, cancellation, additional expense or inconvenience arising from the acts or omissions of independent suppliers or circumstances beyond OTT’s reasonable control. Where OTT’s liability may lawfully be limited, it is limited to the maximum extent permitted by law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law
18. MARKETING AND IMAGES
Photographs and video may be taken during OTT tours and events. By participating, travellers acknowledge that they may be photographed or recorded and agree that OTT may use such images for legitimate promotional and marketing purposes, including on its website, social media, advertising and other marketing materials. Travellers who do not wish to appear in marketing material must notify OTT in writing before or during the tour. OTT will take reasonable steps to avoid using identifiable images of that traveller in future marketing.
19. PRIVACY
OTT handles personal information in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where applicable. Personal information may be collected, used and disclosed as reasonably necessary to arrange and administer travel services. 20. COMPLAINTS
If you have a complaint about a booking or service arranged by OTT, please contact OTT as soon as reasonably practicable so the matter can be investigated and, where possible, resolved. Complaints relating to services provided by third-party suppliers may need to be addressed to the relevant supplier. OTT will provide reasonable assistance where appropriate.
21. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of New South Wales, Australia. Subject to any mandatory rights or protections that cannot lawfully be excluded, the parties submit to the jurisdiction of the courts of New South Wales, Australia.
22. ACKNOWLEDGEMENT
By making a booking with OTT, the traveller acknowledges that they have read and understood these Terms, the applicable itinerary and booking conditions, including the payment, cancellation, insurance and risk provisions, and agree to be bound by them.
